Welcome to InkComply™ Signing Agency LLC. By booking, scheduling, or receiving services, you acknowledge and agree to the following Terms, Policies, and Disclaimers, which are designed to ensure clarity, compliance, and professionalism under California and federal law.

GENERAL SERVICE TERMS

Mobile Services Only
InkComply™ is a mobile-only agency. We do not offer in-office or walk-in appointments. Services are performed at the client’s home, office, hospital, jail, or other agreed-upon public location.

Identification Requirements
All signers must present a valid government-issued photo ID. Per California law, expired IDs are only accepted if issued within the last 5 years. InkComply™ reserves the right to refuse service if identification is missing, expired, or unsatisfactory.

Notarial Scope
InkComply™ acts as a neutral third-party notary. We do not provide legal advice, complete forms, or interpret documents. Clients must review and understand their documents before signing.

• InkComply™ notaries will only perform acts permitted by California law. We cannot advise on the legality, enforceability, or appropriateness of any document presented.

PAYMENTS, DEPOSITS & CANCELLATIONS

Payments: Payments are due at the time of service unless otherwise agreed in writing. InkComply™ accepts Cash and Square (credit/debit via Square or invoice). Invoicing is available for escrow, laboratories, and pre-approved business accounts. Invoices must be paid in U.S. dollars via the accepted payment methods listed above. Returned or disputed payments may result in suspension of services until resolved.

Unpaid Balances: Unpaid invoices may be subject to late fees, collection costs, and legal remedies, including the use of a collection agency or court action.

Cancellations: To avoid a cancellation fee, please provide at least 1 hour’s notice. No-shows or cancellations after travel has begun may incur a $35 fee to cover time and travel expenses.

TRAVEL & LOCATION POLICIES

Service Area
Base pricing includes travel within 5 miles of InkComply™ headquarters in Irvine, CA (Great Park Neighborhood). Additional travel is billed per our posted travel fee schedule. Travel fees will be disclosed prior to confirmation of appointment.

Access to Restricted Locations
Clients must arrange security clearances, escorts, or approvals for facilities such as jails, hospitals, military bases, or detention centers.

DOCUMENT ACCURACY & CLIENT RESPONSIBILITY

Document Preparation
All documents must be complete and ready for signing. Notaries cannot prepare, verify, or interpret document content.

Witnesses
Clients are responsible for providing their own witnesses unless pre-arranged through InkComply™. Witness coordination is available for an additional fee (subject to availability).

DISCLAIMERS

No Legal Advice
InkComply™ is not a law firm and does not provide legal counsel. Clients should consult a licensed attorney for legal questions or document guidance.

Right to Refuse Service
InkComply™ reserves the right to decline service if identification is insufficient, the signer lacks awareness, the environment poses a risk, or the request exceeds the legal scope of notarial authority.

Emergency Appointments
Emergency and overnight appointments (9 PM – 5 AM) are offered based on availability.
A premium rate may apply for urgent services, with payment due upon completion.
Travel fees may vary based on distance and time of request.

PRIVACY POLICY

• Confidentiality
All client documents and personal information are handled with strict confidentiality. InkComply™ does not sell, share, or disclose client data to third parties.

• Notary Journal Retention
Per California law, all notarial acts are recorded in a physical journal securely stored by InkComply™. These records are only accessible via subpoena or inspection by the California Secretary of State.

• CCPA Compliance
InkComply™ complies with the California Consumer Privacy Act (CCPA). Clients may request to review or delete any stored personal information by emailing hello@inkcomply.com.

InkComply™ does not store client data beyond what is legally required in the notary journal. We do not maintain client profiles, email marketing lists, or databases containing personal information. Therefore, most CCPA data deletion requests are not applicable. However, we will promptly honor any valid request to confirm or remove non-essential data (such as email inquiries or appointment requests), if such data exists.

InkComply™ will never request or retain clients’ credit card information for membership or access purposes.

LEGAL JURISDICTION

All services provided by InkComply™ are governed by the laws of the State of California. Clients agree to hold InkComply™ harmless from liability related to document content, errors, or omissions not caused by the notary.

LIMITATION OF LIABILITY

InkComply™’s liability is limited to the fee paid for services rendered. We are not responsible for downstream use of notarized documents, including rejection by third parties.

FORCE MAJEURE (UNCONTROLLABLE EVENTS)

InkComply™ shall not be responsible for failure to perform services due to events beyond our reasonable control, including but not limited to natural disasters, traffic delays, illness, accidents, government restrictions, or technology failures.

CLIENT ACKNOWLEDGEMENT OF UNDERSTANDING

By requesting services, clients acknowledge that they have read, understood, and agreed to these terms and confirm that they are responsible for reviewing their documents prior to signing.

RECORDING OF APPOINTMENTS (IF NECESSARY)

For quality assurance and compliance, InkComply™ reserves the right to record client communications or maintain electronic records of appointments when necessary. Sensitive information will be handled in compliance with applicable privacy laws.

INDEMNIFICATION CLAUSE

Clients agree to indemnify and hold harmless InkComply™, its owners, and agents from any claims, damages, or liabilities arising from client actions, document content, or use of notarized documents.

ELECTRONIC SIGNATURES CLAUSE (FOR INTAKE FORMS/CONSENTS)

Clients agree that electronic acceptance of these terms shall be deemed valid and binding.

PROFESSIONAL CONDUCT

Clients are expected to maintain respectful conduct. Harassment, threats, or inappropriate behavior may result in immediate termination of services.

SCOPE OF SERVICES DISCLAIMER

Services provided are strictly limited to notarial acts, loan signings, courier services, or other services expressly listed on our website. Any request outside this scope will be declined.

DIGITAL & ELECTRONIC SERVICES CLAUSE

If services include electronic or remote notarization, clients acknowledge that technical issues (internet failures, software interruptions) may impact service delivery. InkComply™ is not liable for delays or failures caused by third-party platforms.

CONFIDENTIALITY STATEMENT

All information, conversations, and documents handled by InkComply™ are kept strictly confidential and will not be shared with third parties except as required by law or client request.

ARBITRATION/DISPUTE RESOLUTION

Any disputes shall be resolved through binding arbitration in Orange County, California, under the rules of the American Arbitration Association. Each party shall bear its own costs, and decisions are final. Clients waive the right to participate in class actions or collective claims.
